Promotions & Challenges Terms and Conditions

These Terms and Conditions apply to promotions, competitions, prize draws, giveaways and studio challenges conducted by the business trading as do pilates Kensington at 19 Thompson Street, Kensington VIC 3031 (“do pilates”, “we”, “us” or “the Promoter”).

1. Promotion-specific rules

Each promotion or challenge may have its own details, including:

  • Promotion name

  • Eligibility requirements

  • Opening and closing dates

  • How to enter

  • Entry limits

  • Activities or milestones required

  • Prizes

  • Draw or judging arrangements

  • Winner announcement and claim dates

  • Any additional conditions

These details may be published on the relevant webpage, tracker, entry form, email, social-media post or other promotional material and are referred to as the Promotion Schedule.

The Promotion Schedule forms part of these Terms and Conditions. If there is an inconsistency, the Promotion Schedule will apply to the extent of that inconsistency.

By entering or participating, an entrant confirms that they have read and accepted these Terms and the applicable Promotion Schedule.

2. Eligibility

Eligibility will be stated in the Promotion Schedule.

Unless otherwise stated:

  • Entrants must be current or eligible clients of do pilates Kensington with valid class access during the promotion.

  • Entrants under 18 must have permission from a parent or legal guardian.

  • One entry tracker or registration is permitted per person.

  • Employees, instructors, contractors and their immediate family members may participate for community purposes but are not eligible to win a prize unless the Promotion Schedule expressly states otherwise.

  • The Promoter may request reasonable evidence of identity, age, eligibility, class attendance or completion of an entry requirement.

An entrant who does not satisfy the eligibility requirements may be excluded.

3. Promotion period

Each promotion begins and ends on the dates and times stated in its Promotion Schedule.

Unless otherwise specified, all dates and times are based on Melbourne, Victoria time.

Entries received before the opening date or after the closing date will not be accepted. Entrants are responsible for submitting their entry or completed tracker by the stated deadline.

4. How to enter

Entrants must follow the entry instructions in the Promotion Schedule.

Entries must be complete, truthful, legible and submitted through the required method. Entries that are incomplete, duplicated, altered, submitted late or otherwise inconsistent with the published rules may be rejected.

Automated, bulk, fraudulent or third-party entries are not permitted.

There is no separate fee to enter a prize draw unless expressly stated and permitted by law. Entrants may still need valid class access or an eligible membership or class pack where ordinary studio attendance forms part of a challenge.

5. Class attendance and challenge activities

Where entries are earned through studio attendance:

  • Only classes actually attended during the stated promotion period count.

  • Bookings that are cancelled, late-cancelled or recorded as no-shows do not count.

  • Standard booking, cancellation, waitlist and late-arrival policies continue to apply.

  • Classes cannot be counted more than once unless the Promotion Schedule expressly permits it.

  • Classes completed before or after the promotion period do not count.

  • The studio’s booking records will be used to verify attendance, subject to correction of any clear administrative error.

Where a promotion includes activities, milestones or community challenges, entrants must complete them as described and record any requested names, dates or details. The Promoter may reasonably verify completion.

6. Fair participation

Entrants must participate honestly and respectfully.

The Promoter may reject an entry or disqualify an entrant where there are reasonable grounds to believe that the entrant has:

  • Provided false or misleading information

  • Falsified attendance or activity details

  • Tampered with a tracker or entry

  • Submitted duplicate or unauthorised entries

  • Interfered with the fair operation of the promotion

  • Engaged in abusive, unsafe or inappropriate conduct

  • Breached these Terms, the Promotion Schedule or studio policies

Before disqualifying an entrant, the Promoter may request further information or an explanation where reasonably appropriate.

7. Health and safe participation

Participation in a challenge is voluntary. Entrants should choose a class goal appropriate for their experience, health and circumstances.

Entrants are responsible for:

  • Considering whether they are fit to participate

  • Informing the instructor of relevant injuries, pregnancy, health conditions or movement restrictions

  • Following reasonable safety instructions

  • Selecting appropriate class levels

  • Modifying or stopping exercise when necessary

  • Seeking medical advice where appropriate

Challenge goals are not medical or fitness advice and should not encourage unsafe or excessive participation. Entrants are not required to continue if doing so would be unsafe or inappropriate.

Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded.

8. Prize draws and judging

The Promotion Schedule will state whether winners are selected:

  • Randomly through a prize draw; or

  • Based on skill, merit or stated judging criteria.

For a random draw, each valid entry has an equal chance of being selected.

For a skill-based promotion, eligible entries will be assessed against the published judging criteria. Unless required by law, the judges’ decision is final and correspondence will not be entered into.

The Promoter may verify an entrant’s eligibility and entry before confirming a winner.

9. Winner notification and prize claims

Winners will be contacted or announced using the method and by the date stated in the Promotion Schedule.

Entrants are responsible for ensuring their contact information is accurate and monitoring the stated communication channel.

A winner may be required to confirm their identity and eligibility before receiving a prize.

If a winner:

  • Cannot be contacted after reasonable attempts;

  • Does not claim the prize within the stated claim period;

  • Is found to be ineligible; or

  • Has submitted an invalid entry,

the Promoter may withdraw the prize and conduct a redraw or select another eligible winner, subject to applicable law.

10. Prizes

Prizes are as described in the Promotion Schedule.

Unless otherwise stated:

  • Prizes are not transferable, exchangeable or redeemable for cash.

  • A prize cannot be sold or assigned to another person.

  • Membership and class prizes are subject to standard booking, cancellation, expiry, availability and fair-use policies.

  • Winning a class-based prize does not guarantee access to a particular class, time or instructor.

  • Promotional class credits have no cash value.

  • Any incidental expenses associated with accepting or using a prize are the winner’s responsibility.

  • A winner is responsible for obtaining independent advice about any tax implications.

If a prize becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may provide a reasonably equivalent substitute, subject to applicable law.

11. Third-party prizes and businesses

Some prizes or challenge activities may involve third-party businesses.

Unless expressly stated otherwise:

  • A third party does not sponsor, administer or endorse the promotion.

  • Third-party products, services and vouchers are subject to the provider’s own terms, availability and expiry conditions.

  • The Promoter is not responsible for the acts, omissions, availability or service quality of an independent third party, except to the extent responsibility cannot legally be excluded.

  • Visiting or purchasing from a local business is voluntary unless the Promotion Schedule clearly states otherwise.

  • No purchase from a third-party business is required unless expressly disclosed.

12. Social media, reviews and public content

Unless expressly stated in the Promotion Schedule, entrants are not required to post, share, tag, follow, review or rate do pilates or another business.

A Google review, social-media review or rating will not be required or rewarded as an entry condition.

If a promotion invites entrants to submit photographs, videos, written content or social-media posts, the Promotion Schedule will explain how that content may be used. The Promoter will not publish identifiable participant content for marketing purposes without the appropriate permission.

Entrants must not submit content that infringes another person’s privacy, intellectual property or other legal rights.

13. Social-platform disclaimer

Unless expressly stated otherwise, promotions conducted by do pilates are not sponsored, endorsed, administered by or associated with Meta, Facebook, Instagram, Google or any other social platform.

Entrants release the applicable platform from responsibility connected with the promotion to the extent permitted by law.

Questions and complaints about a promotion should be directed to do pilates rather than the relevant social platform.

14. Personal information and winner announcements

The Promoter may collect and use personal information to:

  • Administer the promotion

  • Verify eligibility and entries

  • Contact entrants or winners

  • Deliver prizes

  • Prevent fraudulent or duplicate entries

  • Meet legal and record-keeping obligations

Information may be provided to service providers where reasonably required to administer the promotion.

Unless otherwise stated, winners may be announced using their first name and surname initial. Entrants should contact the studio before entering if they have a safety or privacy concern about a public announcement.

Personal information will otherwise be handled in accordance with the do pilates Privacy Policy and applicable privacy laws.

Entry into a promotion does not automatically constitute consent to receive unrelated marketing communications.

15. Technical and administrative issues

The Promoter is not responsible for an entry that is lost, delayed, corrupted, misdirected or not received because of a technical issue outside its reasonable control.

Where a studio, booking-system or administrative error materially affects an entry, the Promoter will take reasonable steps to correct the error and administer the promotion fairly.

Entrants should notify the studio promptly if they believe an attendance record or entry has been recorded incorrectly.

16. Changes, suspension or cancellation

The Promoter may reasonably amend, suspend or cancel a promotion if circumstances beyond its control prevent it from being conducted safely, fairly or as originally planned.

Where practicable, material changes will be communicated using the same channels used to advertise the promotion.

The Promoter will not change the rules merely to disadvantage an entrant after entry. Any changes will remain subject to applicable law and regulatory requirements.

17. Liability and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

To the maximum extent permitted by law, the Promoter is not responsible for indirect or consequential loss arising from participation in a promotion or use of a prize.

Where the Promoter’s liability can lawfully be limited, it will be limited to the extent permitted by law.

Entrants remain responsible for their own conduct and for using prizes and participating in activities safely and appropriately.

18. Complaints and decisions

Questions or complaints should be raised with do pilates Kensington as soon as reasonably possible through the studio’s published contact details.

The Promoter will consider complaints in good faith and may request supporting information.

Subject to applicable law, the Promoter’s reasonable decision regarding eligibility, verification, administration and prize allocation is final.

19. Governing law

These Terms are governed by the laws of Victoria, Australia.

Entrants submit to the jurisdiction of the courts and tribunals of Victoria and any courts entitled to hear appeals from them.
